State agency with marijuana oversight issues rule on transport vehicles

The Michigan Marijuana Regulatory Agency (MRA) recently ruled that licensed secure transporter vehicles involved in Michigan’s cannabis industry do not have to be parked overnight at the company’s place of business.

According to a previous rule set forth by the Medical Marihuana Facilities Licensing Act, all secure transport vehicles were required to be kept overnight at the company’s place of business.

The MRA ruled vehicles could be parked elsewhere as long as they do not contain any marijuana products. The agency said secure transporters must report the addresses where the vehicles will be stored via a licensee’s staffing plan. The staffing plan must contain information where transporter vehicles will be stored in order to pass inspections by the state. 

Overnight storage of marijuana product can only be kept at the licensed facility of the licensed secure transporter, according to the MRA. In addition, the agency noted a licensed transporter may not maintain custody of marijuana products for more than 48 hours, unless with permission of the MRA on a case-by-case basis.

Gov. Gretchen Whitmer authorized the establishment of the MRA in April after the previous regulatory body, the Bureau of Medical Marihuana Regulation, was abolished after complaints that the licensing process took too long.

During a June public hearing, MRA Director Andrew Brisbo reported the agency more than doubled the number of licensing approvals in one month compared to the former regulating agency and processed 122% more applications in May than it did when the board was in charge of licensing.
